CONVENTION AND DEOLARATION BET WE EN THE UNITED KINGDOM AND GERMANY FOR THE SETTLEMENT OF THE SAMOAN AND OTHER QUESTIONS.

The Cominissioners of the three Powers concerned having in their Eeport of the 18th July last expressed the opinion, based on a thorough examination of the situation, that it would be impossible effectually to remedy the troubles and difficulties under which the Islands of Samoa are at present suffering as long as they are placed under the joint administration of the three Governments, it appears desirable to seek for a solution which shall put an end to these difficulties, while taking due account of the legitimate interests of the three Governments.
Starting from this point of view the Undersigned, furnished with full powers to that effect [51]

J. die auf eingehende Prüfung der Sachlage begründete Ansicht ausgesprochen haben, dass es uninöglich sein würde, den Unruhen und Misstanden, von weiehen die Samoa-Inseln gegenwaitig heimgesucht werden, wfrksam abzuhelfen, solange die Insein der gerneinschaftlichen Verwaltung der drei Regierungen unterstellt blieben, erscheint es wünschenwerth eine Lösung zu suehen, die diesen Schwierigkeiten ein Ende machen und gleichzeitig den legitimen Interessen der drei Begierungen Bechnung tragen würde.
Von diesem Gesichtspunkt ausgehend, sind die mit gehörigen Vollmachten ihrer hohen

ARTICLE L
Great Britain renounces in favour of Germany aU lier rights over the Islands of Upolu and of Savaii, including the right of establishing a naval and coaling station there, and her right of extra-territoriality in these islands.
Great Britain similarly renounces, in favour of the United States of America, all her rights over the Mand of Tutuila and the other islands of the Samoan group east of 171° longitude west of Greenwich.
Great Britain recognizes as falling to Germany the territories in the eastern part of the neutral zone established by the Arrangement of 1888 in West Africa. The limits of the portion of the neutral zone falliug to Germany are defined in Article V of the present Convention.
AETICLE II.
Germany renounces in favour of Great Britain all her rights over the Tonga Islands, including Vavau, and over Savage Island, including the right of establishing a naval station and coaling station, and the right of extra-territoriality in the said islands.
Germany similarly renounces, in favour of the United States

ARTIKEL I.
Grossbritannien verzichtet zu gunsten Deutschland auf alle seine Rechte auf die Insein Upolu und Savaii, einschliesslich des Rechts daselbst eine Marine-und Kohlenstation zu errichten, und des Rechts auf Exterritorialitat auf jenen Insein.
In gleicher Weise verzichtet Grossbritannien zu gunsten der Vereinigteii Staaten von Amerika auf alle seine Rechte auf die Insel Tutuila und auf die anderen östlich des 171*™ Langengrads von Greenwich gelegenen Insein der Samoa-gruppe.
Grossbritannien erkennt au, dass die Gebiete im Osten der neutralen Zone, welche durch das Abkommen von 1888 in Westafrika geschaffen worden ist, an Deutschland fallen. Die Grenzen des Deutschland zukommenden Tbeils der neutralen Zone werden durch Artikel V der vorliegenden Convention 1'estgesetzt.
ARTIKEL II.
Deutschland verzichtet zu gunsten Grossbritanniens auf aUe seine Rechte auf die TongaInsein mit Einschluss Vavau's und auf Savage Island, einschliesslieh des Rechts daselbst eine Marine- und Kohlenstation zu errechten und des Rechts auf Exterritorialitat in den verstenend bezeichneten Insein.
In gleicher Weise verzichtet Deutschland zu gunsten der

She recognizes as falling to Great Britain those of the Solomon Islands, at present belonging to Germany, which are situated to the east and southeast of the Island of Bougainville, which latter shall continue to helong to Germany, together with the Island of Buka, which forms part of it.
The western portion of the neutral zone in West Africa, as defined in Article V of the present Convention, shall also fall to the share of Great Britain.
AETICLE III.
The Consuls of the two Bowers at Apia and in the Tonga Islands shall be provisionally recalled.
The two Governments will come to an agree inent with regard to the arrangeinents to be made during the interval in the interest of their navigation and of their commeree in Samoa and Tonga.
AETICLE IV.
The arrangement at present existing between Germany and Great Britain and concerning the right of Germany to freely engage labourers in the Solomon Islands belonging to Great Britain shall be equaUy extended to those of the Solomon Islands mentioned in Article II, which fall to the share of Great Britain.

Der westliche Theil der neutralen Zone in Westafrilca, wie derselbe in Artikel V der vorliegendén Convention festgesetzt ist, wird ebenfalls au Grossbritannien fallen.
AETIKEL III.
Die beiderseitigen Consuln in Apia und in den Tonga-Insein werden bis auf weiteres abberufen.
Die beiden Eegierungen werden sich über die in der Zwischenzeit im Interesse ihrer Schifffahrt und ihres Hadels in Samoa und auf den TongaInsein zu treffenden Einriehtungen verstandigen.
AETIKEL IV.
Die zur Zeit zwischen Deutschland and Grossbritannien bestellende Ubereinkunft betreffend das Eecht Deutschlands, auf den Grossbritannien gehörigen Salomons-Inseln Arbeiter frei anzuwerben, wird auch auf die in Artikel II bezeichneten deutsehen SalomonsInseln, die an Grossbritannien fallen soHen, ausgedehnt.



AETICLE V.
In the neutral zone the frontier between the Gernian and English territories shall be formed by the Eiver Daka as far as the point of its intersection with the 9th degree of north latitude, thence the frontier shall continue to the north, leaving Morozugu to Great Britain, and shall be fixed on the spot by a Mixed Gommis sion of the two Powers, in such manner that Gambaga and all the territories of Mamprusi shall fall to Great Britain, and that Yendi and all the territories of Chakosi shall fall to Germany.
AETICLE VI.
Germany is prepared to take into consideration, as much and as far as possible, the wishes which the Government of Great Britain may express with regard to the dcvelopment of the reciprocal Tariffs in the territories of Togo and of the Gold Coast.
AETICLE VII.
Germany renounces her rights of extra-territoriality in Zanzibar, but it is at the same time understood that this renunciation shall not effectively come into förce till such time as the rights of extra-territoriality enjoyed there by other nations shaU be abolished.
AETICLE VIII.
The present Convention shall be ratified as soon as possible,

In der neutralen Zone wird die Grenze zwischen den deutsehen und den Grossbritannischen Gebieten durch den Daka-Fluss bis zum Schnittpunkt desselben mit dem 9ten Grad nördlicher Breite gebildet werden; von dort soll die Grenze in nördlicher Eichtung, indem sie den Ort Morozugu an Grossbritannien lasst, laufen und an Ort und Stelle durch eine gemisebte Commission der beiden Maohte in der Weise festgesetzt werden, dass Gambaga und die sammtlichen Gebiete von Mamprusi an Grossbritannien, Yendi und die sammtlichen Gebiete von Chakosi an Deutschland fallen.
AETIKEL VI.
Deutechlaud ist bereit, etwaigen Wünschun der Grossbritannischen Eegierung in Bezug auf die Gestaltung der beiderseitigen Zolltarife in Togo und der Goldküste nach Möglichkeit und in weitgehendster Weise entgegenzukommen.
AETIKEL VIL
Deutschland giebt seine exterritorialen Eechte in Zanzibar auf: iedoch ist gleichzeitig verabredet, dass dieser Verzicht erst mit dem Zeirpunkt in Kraft treten soU, an welchem die anderen Nationen doit zustehenden Exterritorialitats-rechte ebenfalls aufgehoben sein werden.

Declaration.
It is clearly understood that by Article II of the Convention signed to-day, Germany consents that the whole group of the Howe Islands, which forms part of the Solomon Islands, shall fall to Great Britain.
It is also understood that the stipulations of the Declaration between the two Governments signed at Beilin on the lOth April, 1886, respecting freedom of corumerce in the Western Pacific, apply to the islands mentioned in the aforesaid Convention.
It is similarly understood that the arrangement at present in force as to the engagement of labourers by Germans in the Solomon Islands permits Germans to engage those labourers on the same conditions as those which are or which shall be im-

Es ist gleichfalls ausgemaeht, dass die Bestimmungen der von den beiden Eegierungen am lOten April, 1886, zu Berlin unterzeichneten Declaration betreffend die Handelsfreiheit im westlichen Stillen Ocean auf die in der vorstehenden Convention erwahnten Insein anwendbar sind.
Es ist ebenso verabredet worden, dass die zur Zeit bestehende Ubereinkunft über die Anweibung von Arbeitern auf den Salomons-Inseln durch deutsche Eeichsangehörige den letzteren gestattet, diese Arbeiter unter denselben Bedingungen anzu-



werben, welche Grossbritannischen, nicht auf jenen Insein wohnhafteu Unterthanen auf erlegt sind oder noch auferlegt werden.
