§ 319. p. 585. Ajouter a la fin du § 319 :

La juridiction francaise a cru pouvoir aller jusqu'a citer en même temps, dans certains de ses arrêts, comme bases de sa décision, tant la Déclaration de Paris violée, que le décret violateur. Ainsi qu'il appert du jugement Noordam, n°. 2, and other vessds (1169), la cour anglaise a été d'avis que les conventions de La Haye pouvaient également être violées a titre de représailles, même par rapport aux neutres:

„I ought, perhaps, to mention one argument which was raised; and perhaps it is necessary to deal with it, because I think, if it be a sound argument, the result of it would be to make the Reprisals Order bad. It was said that, by reason of the Eleventh Hague Convention, dealing with correspondence [voir ci-après, § 393 et ss.], that bonds, securities,

and coupons cannot be seized I am not at all satisfied, to begin with,

that bonds and securities are correspondence.... It is argued that! because people choose to pay the letter postal rate instead of the parcels post rate, what is sent in that way becomes inviolable .... I am not satisfied that that is the right view to take of what the Convention was intended to cover [comp. §§ 395 et 396] ; but if it be the right view, it seems to me to follow, from the décisions of the Privy Council in the Stigstad (1048) [voir ci-après, sous (2)] and other cases, that a Convention of this kind cannot deprive one beUigerent of the right of reprisal against another belligerent, especially if that other belhgerent is breaking every possible canon of International Law, and that the belhgerent may take measures against him which are not justified by the ordinary canons of International Law. The question is, Is he, in doing that, engaging in something which is attended with ünreasonable inconvenience and detriment to neutrals ? In my opinion, no case is shown here that what was being done in regard to these securities would have been attended with an ünreasonable amount of inconvenience or detriment to neutrals, and I do not think that there is anything in any Convention which makes this Reprisals Order invalid."

Cette dernière phrase, mise en rapport avec les autres citations, aboutit a la thèse intolérable que, même vis-a-vis des puissances neutres, la totalité des régies du droit international, tant coutumier que conventionnel, serait subordonnée a 1'arbitraire souverain des représaüles entre belligérants. § 329. p. 604, avant-dernière bgne.
